1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and GetFitDXB ("Company", "we", "us", "our") governing your access to and use of the getfitdxb.com website and all related services (collectively, the "Platform").

By accessing or using the Platform, creating an account, submitting a booking inquiry, listing services, or otherwise engaging with the Platform in any way, you confirm that:

• You are at least 18 years of age
• You have read, understood, and agree to be bound by these Terms
• You have the legal capacity to enter into a binding agreement
• If acting on behalf of an organisation, you have authority to bind that organisation

If you do not agree to these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time. Material changes will be communicated by email or prominent notice on the Platform.

2. Platform Description

GetFitDXB is a two-sided online marketplace that connects individuals seeking fitness and wellness services ("Clients") with fitness and wellness professionals ("Professionals") in Dubai, UAE.

GetFitDXB acts as an intermediary platform only. We do not:

• Directly provide fitness training, wellness, or any other service listed on the Platform
• Process payments between Clients and Professionals
• Employ or contract the Professionals listed on the Platform
• Guarantee the quality, safety, or outcome of any service booked through the Platform

All fitness and wellness services are provided directly by the independent Professionals. GetFitDXB provides the technology and tools to connect both parties.

3. User Accounts

3.1 Account Creation

Creating an account on GetFitDXB is free for Clients. Professional accounts are subject to verification and the terms described in Section 5. You agree to provide accurate, current, and complete information and to keep your account details updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at hello@getfitdxb.com if you suspect any unauthorised access to your account.

3.3 One Account Per User

Each individual may hold only one Client account. Professionals may hold multiple accounts for distinct services subject to separate subscription agreements.

4. Terms for Clients

4.1 Free to Browse and Inquire

Browsing trainer profiles, searching categories and areas, and submitting booking inquiries on GetFitDXB is free for Clients. No credit card or payment is required to use the Client features of the Platform.

4.2 Direct Arrangements

All session arrangements, including pricing, scheduling, session format, and payment terms, are agreed directly between you and the Professional. GetFitDXB is not a party to these arrangements and bears no responsibility for their execution.

4.3 Accurate Information

When submitting booking inquiries, you must provide accurate and truthful information about your health status, fitness experience, and any medical conditions relevant to the services requested. Misrepresentation of health conditions that could affect the safety of training is a breach of these Terms.

4.4 Medical Disclaimer

Fitness and wellness activities carry inherent risks. You are advised to consult a medical professional before beginning any new fitness programme, particularly if you have pre-existing health conditions. GetFitDXB does not provide medical advice.

5. Terms for Fitness Professionals

5.1 Eligibility

To list services on GetFitDXB, you must:

• Hold valid, current certifications relevant to your listed services
• Be legally permitted to work in the UAE (visa, work permit, or freelance permit)
• Be aged 18 or over
• Provide accurate information about your qualifications, experience, and services

5.2 Profile Accuracy

You warrant that all information in your profile, including certifications, pricing, areas served, and service descriptions, is accurate and up to date. Misrepresentation of qualifications or services is grounds for immediate account termination.

5.3 Independent Contractor Status

Professionals are independent contractors, not employees, agents, or partners of GetFitDXB. You are solely responsible for your tax obligations, insurance coverage, and compliance with UAE regulations relating to the provision of your services.

5.4 Client Conduct Standards

When engaging with Clients through the Platform, Professionals must:

• Respond to booking inquiries within 24 hours where possible
• Honour confirmed bookings or provide adequate notice of cancellation
• Maintain appropriate professional standards and conduct
• Not solicit or accept payments for bookings made outside the Platform in a way that circumvents the Platform's purpose

6. Subscriptions and Payments

6.1 Subscription Plans

GetFitDXB offers the following paid subscription plans for Professionals:

• Free Plan: AED 0/month — basic profile, 3 photos, unlimited booking requests
• Pro Plan: AED 199/month — 10 photos, featured placement, analytics dashboard
• Elite Plan: AED 499/month — unlimited photos, priority placement, verified badge, custom URL

6.2 Billing

Paid subscriptions are billed monthly or annually in advance. Subscriptions auto-renew at the end of each billing period unless cancelled. You authorise GetFitDXB to charge your payment method for the applicable subscription fee.

6.3 Cancellations and Refunds

You may cancel your subscription at any time. Your plan remains active until the end of the current billing period. We do not provide pro-rated refunds for unused subscription time. Annual plans may be subject to different refund terms as communicated at the time of purchase. See our Refund Policy for full details.

6.4 Price Changes

We may change subscription pricing with 30 days' notice to active subscribers. Continued use of the Platform after a price change constitutes acceptance of the new price.

7. Prohibited Conduct

You agree not to:

• Provide false or misleading information about yourself, your qualifications, or your services
• Post fake reviews or manipulate the Platform's rating system
• Harass, abuse, or threaten other users of the Platform
• Use the Platform for any illegal purpose or in violation of UAE law
• Scrape, crawl, or systematically extract data from the Platform without permission
• Attempt to hack, disrupt, or gain unauthorised access to Platform systems
• Impersonate any person or entity
• Spam other users with unsolicited commercial messages
• Create multiple accounts to circumvent bans or restrictions
• Use the Platform to promote services that compete with GetFitDXB in a way that violates these Terms

8. Content and Intellectual Property

8.1 Platform Content

All content on the GetFitDXB Platform — including text, graphics, logos, images, and software — is owned by or licensed to GetFitDXB and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8.2 User-Submitted Content

By submitting content to the Platform (profile descriptions, photos, reviews, etc.), you grant GetFitDXB a non-exclusive, worldwide, royalty-free licence to use, display, and promote that content in connection with the Platform and our marketing activities.

You warrant that you own or have the right to submit all content you provide, and that it does not infringe any third-party rights.

8.3 Profile Photos

Professionals are responsible for ensuring they have the right to use all photos submitted to their profile. Images depicting identifiable third parties require appropriate consent.

9. Reviews and Ratings

GetFitDXB allows verified Clients to submit reviews of Professionals. By submitting a review, you warrant that:

• You have personally experienced the service being reviewed
• Your review is honest, accurate, and in good faith
• Your review does not contain defamatory, harassing, or illegal content

We reserve the right to remove reviews that violate these standards. Professionals may not submit reviews of themselves or solicit fake reviews.

10. Limitation of Liability

To the maximum extent permitted by applicable UAE law:

• GetFitDXB provides the Platform on an "as is" and "as available" basis without warranty of any kind
• We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components
• We are not liable for any injury, loss, or damage arising from fitness or wellness services booked through the Platform
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform
• Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless GetFitDXB, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms
• Your provision of or participation in any fitness service booked through the Platform
• Your submission of false, inaccurate, or misleading information
• Any content you submit to the Platform

12. Account Suspension and Termination

GetFitDXB reserves the right to suspend or terminate your account at any time, with or without notice, if:

• You violate any provision of these Terms
• We receive credible complaints about your conduct
• You provide false information about qualifications or services
• Your account becomes inactive for an extended period
• We discontinue the Platform

You may close your account at any time by contacting hello@getfitdxb.com. For Professionals, closing your account does not entitle you to a refund of unused subscription time (see Section 6.3).

13. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates, specifically the laws of the Emirate of Dubai. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

We encourage you to contact us at hello@getfitdxb.com before initiating any formal dispute proceedings. We commit to attempting to resolve disputes informally within 30 days of notice.
